For a compromise agreement to be binding an employee must obtain advice from someone who is a "Relevant Independent Adviser" or "Relevant Adviser" for purposes of the employment legislation which deals with compromise agreements. Although many employees look for a solicitor to provide this service barristers too are "Relevant Independent Advisers" for purposes of the employment legislation concerned with compromise agreements.

As a Direct Public Access Barrister Erich Suter is a "qualified Lawyer" and "Relevant Independent Adviser" authorised by statute to advise on, and to provide an adviser's certificate in respect of, compromise agreements for employees. He also has vast experience in drawing up and negotiating compromise agreements for employers.

This is normally cheaper than using a solicitor and we are able to draft compromise agreements or to advise you on your compromise agreement. We can also provide a valid "adviser's certificate" or "independent adviser's certificate" in respect of a compromise agreement.

A compromise agreement in an employment case is a written termination agreement. Compromise agreements are agreements under which employees leave their employment or agree to settle any claims that they have arising from their employment.

Compromise agreements are governed by Statute and require an employee to obtain advice from a "relevant independent adviser". These agreements apply to settlements of all types of employment rights claims such as unfair dismissal and all other employment rights including: non-payment of wages, minimum wage claims, holidays and holiday pay claims and other statutory employment rights from time off for reasons such as maternity and paternity leave to issues about Sunday working.

Statutory compromise agreements are also used for settling all types of discrimination cases in employment.

Erich Suter has been involved in drafting and negotiating compromise agreements and employment settlements generally on behalf of both employers and employees in all sectors from investment banking, insurance  and financial services companies, professional firms, public and and government bodies and major plc's to companies with only a few employees. He has represented individual employees from senior directors, professionals and managers at all levels to shop and manual employees. From MDs of public companies to cleaners.

Each organisation and each employee has their own individual interests and needs in arriving at a compromise and it is important that each achieves a result in the final settlement of their employment issues which is appropriate for them in their particular circumstances. This can be a last chance for both sides to reach an amicable resolution or an agreed termination of employment on agreed terms.
